Billabong Plumbing & Gas Services Terms and Conditions

1. Introduction

These Terms and Conditions (Agreement) govern the provision of plumbing and gas services by Billabong Plumbing & Gas (Company) to its customers in Western Australia. By engaging our services, you agree to comply with and be bound by this Agreement. Please read these terms carefully before using our services.

2. Scope of Services

2.1. The Company provides plumbing and gas-related services as outlined in our service offerings.
2.2. The services are available within Western Australia.

3. Quotes and Pricing

3.1. The company will provide quotes or estimates for services based on information provided by the customer.
3.2. Pricing includes labour, materials, and any applicable taxes unless otherwise specified.
3.3. Quotes are subject to change based on unforeseen circumstances or additional work required.
3.4. A “Diagnostics Fee” shall be payable if a problem needs to be investigated and identified during the quoting process. This fee will be deducted from the final invoice should the Company be hired for the job.
3.5. Quotes expire after 30 days.

4. Payment Terms

4.1. Invoices for services provided are due within seven (7) days of the invoice being sent, unless otherwise agreed upon in writing.
4.2. Partial invoices will be issued as progress payments for larger jobs that require multiple stages of work. For payment terms of partial invoices, please refer to Clause 4.1 of this document. The Company will not return to the next stage of works until progress payment for previous stage(s) is received in full.
4.3. Late payments may incur interest charges or late fees as per the applicable laws.

5. Booking and Cancellation

5.1. Customers must follow the Company’s booking process as outlined on our website or communicated by our employees.
5.2. Cancellation or rescheduling must be made within 8 hours before the scheduled appointment. Failure to provide adequate notice may result in a cancellation fee.

6. Warranties and Guarantees

6.1. The Company warrants its workmanship for six (6) years as per applicable industry standards and regulations.

7. Liability and Insurance

7.1. The Company maintains appropriate insurance coverage and adheres to safety standards.
7.2. In no event shall the Company be liable for damages exceeding the cost of the services that were provided by the Company.

8. Health and Safety

8.1. Customers must ensure a safe working environment for our technicians and comply with relevant safety regulations.

9. Privacy and Data Protection

9.1. The Company collects and uses customer information in compliance with applicable data protection laws.

10. Dispute Resolution

10.1. Any disputes arising from this Agreement shall be resolved through negotiation, mediation, or arbitration as required by Western Australian law.

11. Termination of Services

11.1. Either party may terminate the service agreement under the circumstances specified in applicable laws or upon mutual agreement.

12. Miscellaneous

12.1. Work involving natural gas or LPG will require by law, a leak test to be carried out on the property before the Company can begin approved works. If the gas system does not hold test pressure, then the gas supply will be turned off as per Western Australian law. The safety regulator, ATCO, will be notified, and the Company will need to locate and repair the pre-existing gas leak at extra cost which will be updated on the quote, before approved works can commence. If the customer does not want the Company to locate and repair the pre-existing gas leak, then the gas supply will remain off, and ATCO will be notified.
12.2. Jobs that require the purchasing of hot water heaters, soak wells, appliances or the like, will include a deposit payable prior to purchasing goods and commencing approved works. For payment terms of deposits, please refer to Clause 4.1 of this document.
12.3. All goods remain property of the Company until invoices are paid in full.
12.4. Where jobs require excavating within the boundaries of the property, extra costs may incur if obstructions such as tree roots, limestone, rock or hard digging, power, telephone, communications, drainage, soak well or septic tanks, or any other existing services are encountered throughout the duration of the job, unless otherwise specified.

13. Customer Acknowledgment

13.1. By engaging our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
